UAE Trademark Registration: How to Protect Your Brand Before You Launch

A business name, logo or product mark can become one of a company’s most valuable assets. But using a brand in the market does not, by itself, give a business registered trademark protection in the UAE.

Registering a trademark helps establish ownership and gives the owner legal rights in relation to the mark and the goods or services covered by the registration. Businesses planning a launch, entering a new market or investing in marketing should consider checking and protecting their brand early.

What can you register as a trademark?

A trademark can include a brand name, logo or other distinctive sign used to identify a business’s goods or services. The application must specify the goods or services and the relevant category or class for which protection is sought. The UAE Trademark Law states that a registration certificate records the mark and the goods or services and category covered.

This makes the scope of the application important. A registration for one category does not automatically protect a brand across every product or service a business may offer.

The UAE trademark registration process

The Ministry of Economy and Tourism’s registration process generally includes these stages:

  1. Prepare the application. Confirm the mark, the proposed owner and the goods or services to be covered.

  2. Submit the application. Applications are submitted through the Ministry’s online service with the required documents.

  3. Examination. The Ministry reviews the application and issues a decision.

  4. Publication. If accepted, the mark is published in the official trademark bulletin.

  5. Objection period. Third parties have 30 days from publication to file an objection.

  6. Final registration. If the process proceeds without a successful objection, pay the final registration fee and obtain the certificate.

The Ministry currently lists a standard examination fee of AED 750, a publication fee of AED 750 and a final registration fee of AED 5,000, totalling AED 6,500 per category. It also lists an expedited examination option for AED 2,250. Professional service fees and other costs may be additional.

Common mistakes to avoid

Applying before checking for similar marks. A preliminary search can help identify potential conflicts before time and money are committed to an application.

Choosing the wrong owner. The applicant should be the person or entity intended to own the brand. Ownership details should be considered carefully before filing.

Selecting an unclear scope. The application should cover the goods or services the business actually provides or plans to provide. The mark’s registration is tied to the goods or services and category recorded in the application.

Missing follow-up deadlines. Publication and final registration fees have payment deadlines. The Ministry states that penalties may apply when these fees are paid late.

How long does trademark protection last?

A UAE trademark registration is protected for 10 years from the date of filing and can be renewed for similar periods, subject to the applicable requirements.
