Is a trade licence name enough?

A trade name and a trademark serve different purposes. A trademark application concerns the sign a business wants to use to identify its goods or services. The UAE Ministry of Economy and Tourism has a separate process to examine and register trademarks, as well as a service to search its trademark register. Founders should check the proposed brand before assuming that a trade licence or domain name settles the trademark question.

What should you review before applying?

Start with the name and logo you actually intend to use. Consider whether they are distinctive, whether similar marks appear in a trademark search, and which goods or services the business needs to cover. A company selling products and offering services may need to consider both when planning its application.

It is also sensible to confirm who will own the trademark. The applicant should fit the business’s ownership and licensing plans, especially where the founders operate through more than one company.

What happens after an application is submitted?

The Ministry’s process includes application review, publication of an approved mark in the official trademark bulletin, a 30-day objection period, and final registration if the application proceeds successfully. The Ministry lists a trademark image and, for a company applicant, a trade licence among the core documents. Other documents may be required depending on who submits the application and the type of mark.

Because an application can be examined or opposed, filing it should not be treated as a guarantee that the mark will be registered.

A practical launch sequence is to check the proposed mark, review the relevant goods and services, decide the correct applicant, and then prepare the filing. Taking these steps before a major spend on packaging or promotion gives the business a clearer basis for its brand decisions.
